This paper will mainly focus on the EU approach to net neutrality, notably the adequacy of existing and future EU rules to tackle the issue and the ongoing policy debate. It will also consider whether the market has effectively worked around the regulatory lacunae by looking into the relationships between the telecoms industry, as a regulated sector, and the over-the-top (OTT) players. In this regard, it will explore to what extent there is a real battle between telcos and OTTs or if both parties are already finding their own ways to overcome their (apparent) disputes.  相似文献

Diplomatic relations between Russia and South Africa were established in 1992, before South Africa's transition to democracy was completed. This move was perceived as a betrayal by many in both countries and beyond. For many decades the Soviet Union supported the African National Congress in its fight against the apartheid regime. South Africa's National Party government, in its turn, presented the USSR as the main force behind the ‘total onslaught’ – an all-out war purportedly waged against South Africa by international communism. Yet it was with the National Party government that the Russians established diplomatic relations. This article looks into the reasons for this change of heart in Moscow and Pretoria, discusses the political forces behind the decision to establish diplomatic relations, and analyses the process that led to this event and the results of establishing diplomatic relations the way it happened and at the time it happened for both countries.  相似文献

自1969年德国刑法大改革至今的五十年间,德国的刑事立法活动非常频繁。在此期间,德国立法机关不但对《刑法典》总则犯罪论部分的规定进行了彻底的修订,而且针对犯罪的法律后果以及刑法分则乃至附属刑法中的诸多罪名进行了持续的改革,在恐怖主义犯罪、妨害公务犯罪、毒品犯罪以及保安监禁等领域尤其如此。整体而言,德国立法者在过往半个世纪中日趋侧重功能主义的积极刑事立法观,导致德国刑法逐步从传统法治国背景下的法益保护法和市民防御法转向以社会控制为主导的国家干预法和社会防卫法,造成了诸多难以与现有法律体系和学说理论相协调的象征性立法。我国应当从德国近五十年的刑事立法中吸收其先进经验,对其中的弊端也要引以为戒。  相似文献

党的十八大以来,以习近平同志为核心的党中央高度重视老龄化和老年人生活,养老工作养老政策体系日益完备,居家养老服务体系初步建立。利用2019年"中国老龄化和养老工作调查"数据,从服务供给角度分析居家养老服务建设对老年人满意度的影响,居家养老服务总体上提高了我国老年人满意度水平,对环境满意度影响高于生活满意度;呈现较强增量效应,即服务项目数量越多,老年满意度越高;呈现异质性效应,健康护理类服务影响最大,精神文化类和权益保障类影响较大,生活辅助类没有显著正向影响。根据我国现阶段老年人年龄结构特征,养老服务要重视注重由"扶弱型"向"普及型"、从"补充型"向"提高型"转变,鼓励多元主体供给,更好满足老年人多层次需求,提高老年人多方面满意度。  相似文献

与先前行政审批制度改革相比,党的十八大以来大力推进的"放管服"改革更加强调权力调整的动态性、整体性、系统性,其对于优化政府职责、转变监管方式、深入推进国家治理体系和能力现代化具有明显的积极意义。但此轮"放管服"改革依然沿袭了行政审批制度改革的运动化、政策化思路,并不完全符合法治政府建设的基本要求。从职权法定、监管工具的动态调整、优化公共服务的基本法则三个方面,"放管服"改革的行政法意义和合法性风险可以得到更加清晰的呈现。要提升"放管服"改革的法治品性,需要以《行政许可法》的有效实施为核心,通过设立专门的社会化的"放管服"改革委员会、激活行政许可评价制度、引入更广泛的专家和社会参与、完善试验改革的授权制度、优化规制工具分析评价制度几个方面来实现。  相似文献

This article contests the misconception that the Hall of Memory of the Australian War Memorial, Canberra, represents an irreligious space. While accommodating the expectations of a post-secular society, this belief fails to recognise the influence of Christianity upon the generation that experienced World War I and developed the memorial practices that arose in response to it. Veteran-artist M. Napier Waller embedded complex religious symbolism in the scheme of three windows he designed and executed for the hall. Drawing on his individual experience of battle, personal philosophy of art and the medieval customs of his forebears, Waller told the story of Australia’s experience of the war and aligned a nation’s sacrifice with that of Christ: His Crucifixion, Resurrection and Ascension are symbolised in the south, west and east windows, respectively. The inclusion of a nurse was central to Waller’s plans and required he manipulate the men creating the memorial to achieve his goal. In doing so, he neutralised the greatest threat to his vision: its founder, Charles Bean, and located a woman of many identities—a Martial Madonna—as the heart of national sacrifice in Australia’s premier war memorial.  相似文献

生态系统有价和有偿使用已成共识。通过对生态系统服务价值研究方法和主要几类生态系统的服务价值研究结果进行梳理,发现生态系统服务价值相关评估方法的科学性、数据选取的可信度和研究结果的准确性以及研究结果应用的可行性等几个方面面临一些现实问题,影响到评估结果的采纳和应用。随着可持续发展战略的深入实施,迫切需要对生态系统服务价值评估方法和现实问题进行深入探讨,重新定位生态系统的价值和价格。  相似文献

During the Korean War, the Office of the Quartermaster General's Graves Registration Service (GRS) was responsible for the recovery, processing, identification, and repatriation of US remains. In January 1951, the GRS established a Central Identification Unit (CIU) at Kokura, Japan. At the Kokura CIU, postmortem dental examinations were performed by the dental technicians. Thirty‐nine postmortem dental examinations performed at the CIU were compared to the findings documented in the Forensic Odontology Reports written at the JPAC Central Identification Laboratory (CIL). Differences were noted in 20 comparisons (51%). The majority of the discrepancies was considered negligible and would not alter the JPAC decision to disinter a set of unknown remains. Charting discrepancies that were considered significant included the occasional failure of the Kokura technicians to identify teeth with inter‐proximal or esthetic restorations and the misidentification of a mechanically prepared tooth (i.e., tooth prepared for a restoration) as a carious surface.  相似文献

本文首先概括了当代中国公共服务实践中存在的诸多“怪相”,并把“怪相”归为公共服务需求、供给和结果三类问题,而问题的根源在于公共服务体制缺陷。然后,从公共服务过程的角度,提出公共服务全程评估的概念,即对公共服务需求一供给一结果整个过程的评估,并认为公共服务全程评估,是既定公共服务体制下的一种可行的公共服务改革策略,也是改善公共服务的一种机制保障。  相似文献
